1. Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Subscriber”, “User”, or “you”) and POV Digital Solutions (“we”, “us”, or “our”), operating under the trade name reviews.pov (“the Platform”), with registered offices at [BUSINESS POSTAL ADDRESS] and registered as [LEGAL BUSINESS NAME].

By creating an account, subscribing to a paid plan, scanning a generated QR code, or utilizing any portion of our software services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the platform.

2. Platform Description & Independence from Google

reviews.pov is a software-as-a-service (SaaS) productivity tool designed to help businesses reduce friction when requesting feedback from genuine, in-person customers.

CRITICAL DISCLAIMER REGARDING GOOGLE SERVICES:

Independent Operation: reviews.pov is solely operated by POV Digital Solutions. We are not affiliated, endorsed, sponsored, authorized, or partnered with Google LLC or Alphabet Inc.
No Automated Posting: reviews.pov does not publish, transmit, or alter reviews on Google Business Profile on behalf of businesses or customers.
Customer Autonomy: All reviews are drafted collaboratively with the consumer. The consumer makes the independent, voluntary decision whether to copy the drafted suggestion and submit it through Google's public website using their personal Google account.
No Guarantee of Ratings or Rankings: We do not guarantee any specific volume of reviews, higher star ratings, improved search rankings, or commercial outcomes.

3. Mandatory Anti-Gating & Genuine Review Compliance

In full accordance with consumer protection statutes, advertising standards, and search engine policy guidelines, all subscribers agree to strictly follow our ethical review standards:

A. Strict Anti-Gating Rule

Subscribers are expressly prohibited from attempting to use reviews.pov to filter, gate, intercept, hide, or suppress negative or low-star customer reviews (ratings of 1, 2, or 3 stars). The platform ensures that every customer, regardless of the star rating chosen, is provided immediate, unhindered access to proceed to the public Google review destination.

B. Prohibition on Fake or Compensated Reviews

Subscribers must not generate fake reviews, submit reviews for themselves or competitors, offer financial incentives, discounts, gifts, or kickbacks in exchange for reviews, or mislead consumers. AI suggestions generated by reviews.pov must reflect genuine customer experiences.

C. Immediate Suspension for Violations

Any subscriber found attempting to manipulate the review flow to deceive consumers or violate anti-gating principles will have their account immediately suspended without refund.

4. Subscription Plans, Fees & Billing Terms

reviews.pov offers commercial software subscriptions under prepaid 30-calendar-day intervals:

Basic Plan₹299 / 30 days

Ideal for single-location businesses. Includes branded QR code generation, AI review assistance (up to benchmarked monthly session allowance), and real conversion telemetry.

Pro Plan₹799 / 30 days

For high-volume businesses. Includes elevated AI generation limits, customizable brand voice tones, priority inference routing, and comprehensive telemetry.

Prepaid 30-Day Terms: Subscriptions are billed in advance for a fixed 30-day duration via our authorized payment partner, Cashfree Payments.

No Automatic Recurring Debit Mandates: Subscriptions operate on a non-mandated prepaid renewal structure. We do not automatically debit your bank account or payment card upon period expiry. To maintain uninterrupted access, subscribers initiate prepaid renewals from their billing dashboard.

Expiration & Feature Gating: If a prepaid period concludes without renewal, the subscription transitions to expired status. During expiration, access to paid features (generating new QR codes, invoking Cloudflare Workers AI suggestions, and downloading analytics) is paused until renewed.

Taxes: All fees are stated in Indian Rupees (INR) and are exclusive of applicable Goods and Services Tax (GST), which will be itemized at checkout if legally required.

5. Acceptable Use & Platform Security

You agree not to engage in any of the following prohibited activities:

Attempting to bypass, reverse engineer, or exploit Cloudflare Workers AI rate limits or Upstash Redis security locks.
Sending automated, bulk, or scripted requests to review flow endpoints (/api/review-flow/generate or /api/review-flow/event).
Using the platform to generate unlawful, harassing, defamatory, abusive, or sexually explicit content.
Sub-licensing, reselling, or commercially redistributing access to the reviews.pov application without express written permission from POV Digital Solutions.

6. Intellectual Property

All rights, title, and interest in and to the reviews.pov platform—including software architecture, designs, text, brand marks, logos, and algorithms—are the exclusive intellectual property of POV Digital Solutions.

Review text generated by our AI is provided as a suggestion. Once edited and accepted by the consumer, the resulting text belongs to the consumer for publication on Google or other public platforms.

7. Disclaimer of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, POV DIGITAL SOLUTIONS DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL POV DIGITAL SOLUTIONS, ITS FOUNDERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF REPUTATION, SUSPENSION OF THIRD-PARTY ACCOUNTS, OR BUSINESS INTERRUPTION. OUR MAXIMUM TOTAL LIABILITY ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO POV DIGITAL SOLUTIONS DURING THE ONE (1) MONTH IMMEDIATELY PRECEDING THE CLAIM.

8. Governing Law & Jurisdiction

These Terms and any dispute arising from or related to the use of reviews.pov shall be governed by and construed in accordance with the laws of the Republic of India.

Both parties agree that the competent courts situated in [APPROVED GOVERNING JURISDICTION] shall have exclusive jurisdiction over all disputes, controversies, or legal actions arising under or in connection with these Terms.
